Official Rules

NO PURCHASE REQUIRED TO ENTER OR WIN. SWEEPSTAKES VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

ELIGIBILITY: To be eligible to enter or win, an entrant must be 18 years of age or older and, at the end of the Sweepstakes Period, be an employee of a dealership who uses the Polly platform and have an active account on the Polly platform.

In addition to the eligibility requirements above, to be eligible to win an entrant must have referrals that resulted in a minimum number of Connections completed through the Polly platform during the Sweepstakes Period and sign a release allowing Polly to use their name, photo, and any reviews or feedback regarding Polly for marketing purposes. The minimum number of Connections required to enter may vary by location. A Connection means that a dealership customer, referred to Polly via the Polly platform, has discussed insurance quotes and options with a licensed Polly agent.

Employees of Polly Insurance Agency, LLC (“Polly”) and Polly’s affiliates and immediate family (defined for the purposes of this Sweepstakes as parents, spouses, siblings, children) and household members of all such employees are NOT eligible to participate in the Sweepstakes. In addition, residents of California, Delaware, Michigan, New York, Rhode Island, Virginia, Washington, and West Virginia are NOT eligible to participate in the Sweepstakes. Winners of Polly contests or sweepstakes in the last 12 months are NOT eligible to win. The Sweepstakes is subject to all federal, state, and local laws and regulations.

SWEEPSTAKES TIMING: The Polly Customer Stories Sweepstakes ("Sweepstakes") will run from April 1 through April 30, 2023 (the “Sweepstakes Period”), with the drawing held on or after April 30, 2023 and winners announced after May 1, 2023.

HOW TO ENTER: To enter the Sweepstakes, entrants must submit at least one customer story on a form accessed by clicking on a link in the Customer Stories email sent by Polly to the entrant’s email address provided by entrant in the Polly platform (“Entry”). Each customer story submitted counts as one Entry into the Sweepstakes. The customer story must be based on an actual event.

By participating in the Sweepstakes, entrant agrees to these Official Rules.

Any attempt by any person to submit a falsified story will void that person’s Sweepstakes Entries and that person will be disqualified. Sweepstakes Entries must be submitted during the Sweepstakes Period in strict accordance with the instructions and restrictions in these Official Rules. All Entries become the sole property of Polly and receipt of Entries will not be acknowledged or returned. Those who do not follow all of the instructions, provide the required information in their Entry, or abide by these Official Rules will be disqualified. Decisions of Polly are final and binding in all matters relating to the Sweepstakes.

PRIZE DRAWINGS AND WINNER NOTIFICATION: Within fifteen (15) days from the end of the Sweepstakes Period, Polly will conduct a random drawing for the winning Entry from all eligible entries received.

The winner will be notified by email and by phone. Return of any prize notification email as undeliverable may result in disqualification and forfeiture of prize. If a notified winner is not eligible, forfeits prize, or declines prize, another drawing will be held. Polly is not responsible for any lost or stolen prizes after the prize is transferred to the winner’s account in the Polly platform.

TO CLAIM A PRIZE: Prize earnings will be deposited into winner’s account in the Polly platform.

PRIZES: Odds of winning depend on the number of Entries received.

Winners may not substitute, assign or transfer Prizes, and Polly reserves the right to substitute any Prize should the advertised Prize become unavailable or unallowable for any reason. The reporting of Sweepstakes winnings and all federal, state, and local taxes are solely the responsibility of the winners. All other expenses not specified as part of a Prize description are solely the winner’s responsibility.

GENERAL CONDITIONS: If for any reason the Sweepstakes is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, epidemic, pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Sweepstakes (each a “Force Majeure” event), Polly reserves the right at its sole discretion to disqualify any individual Polly deems responsible and Polly further reserves the right to cancel or terminate the Sweepstakes (or portion thereof). In the event the Sweepstakes is cancelled or terminated as a result of a Force Majeure event, Polly reserves the right to select the potential winners in a random drawing from among all eligible entries received up to time of such drawing. Polly assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. Polly is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, cable, satellite, servers, network or Internet service provider (ISP), computer equipment, software, failure of any Entry to be received by Polly due to technical problem or traffic, congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, POLLY RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sweepstakes Entries made by any means which subvert the Entry process are ineligible and will be disqualified. In the event of dispute as to the identity or eligibility of a winner, the winning Entry will be declared made by the authorized user of the Polly account at the time of the Entry.

ADDITIONAL TERMS: By entering, entrant agrees to accept and abide by these Official Rules and agrees that any dispute with regard to the conduct of this Sweepstakes, rule interpretation or award of prize, shall be resolved by Polly, whose decision shall be binding and final. By entering, entrant agrees to be notified using the contact information provided in the entrant’s Entry for the purposes of the administration of this Sweepstakes. By participating, entrant agrees to release and hold harmless Polly, its affiliates and employees, from any injury, loss or damage to person, including death or property damage due in-whole or in-part, directly or indirectly to the acceptance, use, or misuse of a prize, participation in any Sweepstakes-related activity, or participation in the Sweepstakes. Polly is not responsible for any typographical, printing, or other error in the printing of these Official Rules, or any network, computer, mechanical, electronic, human or other errors or problems in connection with this Sweepstakes, including, without limitation, any errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of Entries or emails, or in the announcement of prizes, including such error that may give an erroneous indication that a prize has been won. All Entries become the property of Polly and are not returnable.

Unintelligible entries, entries with incomplete, invalid, incorrect, or noncurrent information and entries that are counterfeit, damaged, or tampered with in any way will be disqualified. Entries that are late, lost, damaged, misdirected, or not delivered are not the responsibility of Polly and will be disqualified. Entries will be deemed made by the holder of the entrant’s email account. Polly is not responsible if a potential winner does not receive a prize because erroneous, expired, canceled, fraudulent, or fake information was provided during the Sweepstakes.

These rules are subject to change as necessary.

DISPUTES/GOVERNING LAW: All disputes concerning the construction, interpretation, validity, effect, and enforceability of these Official Rules will be governed by the laws of Vermont without regard to conflicts of laws provisions. Entrant (i) agrees that exclusive jurisdiction over any legal action arising out of or in connection with the Sweepstakes will be in state or federal courts located in or nearest to Williston, Vermont and by entering consents to such jurisdiction and venue; (ii) consents to resolve any such claims individually and without resort to class action; and (iii) agrees that all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorney’s fees or punitive, incidental, consequential, or any damages other than actual out-of-pocket expenses.
